Welcome to StableZirconium B.V. ("StableZirconium", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of our gym and wellness facilities, services, and website located at stablezirconium.pro.

By accessing our facilities, using our services, or visiting our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services or facilities.

Facility Use and Membership

Our gym and wellness centre is located at Kerkstraat 272, 6586 LR Nijmegen, Netherlands. Membership grants you access to our facilities and services according to your chosen membership level.

Membership Requirements

• Members must be at least 16 years of age (under 18 requires parental consent)
• Valid identification and completed membership agreement required
• Health questionnaire must be completed honestly and accurately
• Monthly membership fees must be paid in advance

Facility Rules

• Appropriate athletic attire and closed-toe shoes required
• Equipment must be used properly and returned after use
• Personal belongings must be stored in designated areas
• Disruptive behaviour or inappropriate conduct is prohibited
• Photography or recording without consent is not permitted

Health and Safety

Your health and safety are our top priorities. By using our facilities, you acknowledge and agree to the following:

• You participate in fitness activities at your own risk
• You will consult with healthcare professionals before beginning any exercise programme
• You will inform staff of any health conditions that may affect your ability to exercise safely
• You will follow all posted safety guidelines and staff instructions
• You will immediately report any injuries or equipment malfunctions

Payment and Billing

Membership fees are billed monthly in advance. Payment methods include direct debit, credit card, or other approved methods. Late payment may result in suspension of membership privileges.

Cancellation Policy

• Memberships may be cancelled with 30 days' written notice
• No refunds for partial months unless required by law
• Cancellation must be submitted in writing or via our official channels
• Outstanding balances must be settled before cancellation becomes effective

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of StableZirconium or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission. Our trademarks, service marks, and logos may not be used without our prior written consent.

Privacy and Data Protection

Limitation of Liability

Our total liability for any claims arising from your membership or use of our facilities shall not exceed the amount of membership fees paid by you in the twelve months preceding the claim.

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless StableZirconium, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our facilities, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Termination

We reserve the right to terminate or suspend your membership immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other members or staff, or is otherwise inappropriate.

Upon termination, your right to use our facilities and services will cease immediately. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, limitation of liability, and governing law.

Changes to Terms

We may modify these Terms at any time by posting the updated Terms on our website. Your continued use of our facilities or services after such changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.
